| 学术复核是学位管理工作的一项重要制度,具有行政性和学术性。它具体应包含哪些方面的制度规定,是制定"学术复核办法"应思考的问题。学术复核主要审查与学术评价结论有对应关系的学术性异议;对专家评阅制度和政策、专家的学术道德和人际关系的异议属学术复核排除事项。构建学术复核参加人制度应处理好:学术复核被申请人与学术复核裁决者重合的问题、学术复核第三人问题、复核申请人范围及其权利问题。学术复核申请的受理标准有三:申请主体特定;利害关系明确;复核请求和理由具体。构建学术复核审理制度要考虑如何确定学术复核机构、如何组织复核专家、如何选择审理方式和如何分配举证责任等问题。学术复核决定应在规定时间内按规定程序围绕学位申请人的"异议"作出。 |

| Academic review, an important system for managing academic degrees, is characterized by both administrative and academic attributes. The specific institutional provisions that should be included in the system are issues to beconsidered when stipulating the academic review measures. An academic review primarily examines objections related to the conclusions of an academic evaluation, but objections that question the expert review system and policies, or the academic ethics and interpersonal relationships of experts are excluded from the academic review.When developing the academic review participant system, it is necessary to address the following issues: The respondent in the academic review being the same person as the adjudicator of the review, the third party involved in academic review, and the eligibility of the applicants for the review and their related rights. Three prerequisites must be met to accept an academic review application: a specific applicant, interests that have been explicitly stated as infringed upon, and a detailed review request with reasons.When developing the academic review trial system, it is important to consider the following: how to determine an academic review institution, how to organize reviewing experts, which trial method to choose, and how to allocate the burden of proof. The academic review judgement should be made within the stipulated timeframe and according to the prescribed procedures. The judgment should focus on the objections raised by the applicant for an academic degree. |
