      研究生师生关系异化影响了人才培养质量的提升。依据高等教育结构与功能关系原理,在依法治教、提升治理体系和治理能力现代化的大背景下,审视研究生师生权利义务关系,认为导师权力与学生权利配置失衡的现实困境、研究生权利救济保障不足的严峻挑战、学生权利意识觉醒对大学治理的高度期待是造成师生关系异化的主要原因。为此,要通过平衡导师权力与研究生权利配置、优化研究生教育内部治理结构、完善校内外协同的权利保障体系来构建研究生权利保障机制,为推进依法治教、完善大学内部治理、提升研究生培养质量提供有效的路径选择。
英文摘要:
      The relationship dissimilation between supervisors and postgraduates affects the upgrading of talent cultivation quality. In accordance with the relationship principle between structure and function, this paper reviews the relationship of rights and obligation between supervisors and postgraduates in the context of managing education by law, improving the governance system and modernizing governance capacity, and analyzes the realistic predicament of imbalanced allocation of supervisor’s power and postgraduate rights, the serious challenges of insufficient right relief and guarantee for postgraduates, and the high expectation of postgraduates for university governance after the rising of their awareness of rights. Upon the belief that those mentioned above are the main reasons for the relationship dissimilation between supervisors and postgraduates, the author suggests that we should construct a mechanism to protect the rights of postgraduates by balancing the allocation of supervisor’s power and postgraduate rights, optimizing the internal governance structure for postgraduate education, and improving the collaborative system to guarantee the rights inside and outside the school, and that we should provide effective path options for further promoting education management by law, improving internal governance of higher learning institutes, and lifting the postgraduate training quality.
